Creditor’s Rights

Negotiation and Drafting of Commercial Contracts

Our experience includes the drafting and review of a variety to commercial contracts. Whether you are looking for us to review provisions which may be out of date, to protect you in the event of litigation of a contract, or to draft a contract from scratch, our firm can assist you.

Bankruptcy Representation

HS&W has vast experience representing parties in bankruptcy proceedings. Although HS&W specializes in representing creditors in bankruptcy, our firm has also represented numerous creditors’ committees, has served as local counsel to committees and has represented debtors in bankruptcy. HS&W represents creditors in Wisconsin’s unique Chapter 128 insolvency proceedings.

Negotiation and Preparation of Loan Documentation

Our attorneys handle all aspects of loan documentation and follow through. Our firm drafts credit agreements, notes, inter-creditor agreements, landlord disclaimers, security agreements, debt-subordination agreements and guaranties. In the unfortunate event that the borrower defaults, HS&W is able to follow through with informal workouts all the way through the civil litigation process to maximize the Lender’s recovery.

Commercial Litigation

HS&W prosecutes and defends all manner of commercial litigation in federal and state courts. Our firm has handled small- and medium-sized cases to extremely large cases involving hundreds of millions of dollars.


HS&W represents a number of property management companies and individual landlords to protect landlord rights and to efficiently navigate the eviction process from the initial eviction to post-judgment collection.


Commercial and Retail Collection

Our firm handles both commercial and retail collection proceedings throughout the United States on both hourly and contingency-fee arrangements. We can represent you in one collection matter or a large volume of collection accounts. We also have established relationships with many collection agencies, attorneys and law lists throughout the country.

Mediation and Alternative Dispute Resolution

The vast majority of disputes result in settlement prior to trial. Jason Pilmaier works with parties to create their own solution to the issues they face. His goal is that the parties stay in control of the process, resolving their issues prior to incurring the costs and uncertainty of the court process. Jason hopes that mediation will facilitate a cooperative process for couples to resolve the many issues facing them as they move through the process of divorce/separation and to develop strategies to resolve issues in the future.
